Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and VastgoedFotoAI.nl ("we", "our", or "us"). By creating an account or using our service, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use VastgoedFotoAI.nl. These Terms apply to all visitors, registered users, and anyone who accesses the service.

VastgoedFotoAI.nl is an AI-powered photo enhancement service for real estate professionals. In plain terms:

• You upload property photos
• Our AI enhances them (virtual staging, style improvements, quality upscaling)
• You download the enhanced images to use in your listings

We use artificial intelligence (specifically Fal.ai) to process your images. AI-generated results may vary and are not guaranteed to meet specific expectations. The results are computer-generated enhancements, not photographs of real modifications.

To use VastgoedFotoAI.nl, you need to create an account. When you do, you agree to:

• Provide accurate information (your real name and a valid email address)
• Verify your email address before using the service
• Keep your password secure and not share it with others
• Accept responsibility for everything that happens under your account
• Let us know immediately if you suspect unauthorized access to your account

You may also be part of a workspace, which lets multiple team members collaborate on projects. The workspace owner is responsible for managing team access and billing.

New workspaces receive 3 free image enhancements to try the service. No credit card is required for the free trial. After your free images are used, you will need to pay to process additional images.

VastgoedFotoAI.nl uses a pay-per-property model. There are no subscriptions or recurring charges. You only pay when you want to process a property.

• Standard (2K resolution): €24,50 per property (up to 30 images) — regular price €49
• Premium (4K resolution): €39,50 per property (up to 30 images) — regular price €79

All prices are excluding 21% VAT.

How Payment Works

• Payments are processed securely by Stripe. We never see or store your credit card details.
• You pay before processing begins. Your images are processed after successful payment.
• Prices may change in the future. We will give reasonable notice before any price increase. Prices paid for already-processed projects will not be affected.

If you are not satisfied with the AI-enhanced results, you may request a refund within 24 hours of processing completion. Send your request to info@nuktup.com and include your project details and reason for dissatisfaction.

We will work with you to make it right or provide a refund. We reserve the right to deny requests that appear to be fraudulent or abusive (for example, requesting refunds after downloading and using all enhanced images).

You own your content

You keep full ownership of all images you upload and all enhanced images you receive. We do not claim any rights over your content.

What you allow us to do

By uploading images, you give us permission to:

• Store your images in our cloud storage (hosted by Supabase)
• Send your images to our AI provider (Fal.ai) for processing
• Store the enhanced results so you can download them
• Automatically delete images 30 days after processing

Your responsibility

You confirm that you have the right to upload and use all images you submit. Do not upload images you do not own or have permission to use. You are responsible for ensuring your images do not violate any third-party rights (such as copyright or privacy rights of people in photos).

Enhanced images produced by our service are AI-generated. This means:

• Results are generated by artificial intelligence and may not perfectly represent reality
• Virtual staging shows potential furniture/decor — it does not represent actual items in the property
• You should clearly disclose to potential buyers/renters that images have been AI-enhanced, where legally required
• We are not responsible for any claims arising from misleading use of enhanced images in property listings

The VastgoedFotoAI.nl platform — including its design, code, brand, and features — is our intellectual property and is protected by copyright and trademark law.

Enhanced images you receive through our service are yours to use freely for your real estate marketing. You may use them in property listings, websites, social media, and printed materials.

When using VastgoedFotoAI.nl, you agree not to:

• Upload images you do not own or have permission to use
• Upload illegal, harmful, or objectionable content
• Try to access other users’ accounts or data
• Attempt to reverse-engineer or copy our AI models or technology
• Overload or interfere with our servers or infrastructure
• Use the service for any fraudulent or deceptive purposes
• Resell access to our service without our written permission
• Use automated scripts or bots to access the service

We aim to keep VastgoedFotoAI.nl available 24/7, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Issues with third-party services we rely on (Fal.ai, Supabase, Stripe)
• Unexpected technical problems

We will do our best to notify you in advance of planned downtime. We are not liable for any losses caused by temporary unavailability of the service.

To the maximum extent permitted by Dutch and EU law:

• VastgoedFotoAI.nl is provided "as is". We do not guarantee specific results from AI processing.
• We are not liable for indirect, incidental, or consequential damages, including lost profits or missed business opportunities.
• Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
• We are not responsible for how you use the enhanced images in your property marketing or any claims that arise from that use.

By you

You can close your account at any time by contacting us at info@nuktup.com. When you close your account, we will delete your data in accordance with our Privacy Policy.

By us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the service. If we terminate your account for reasons other than a Terms violation, we will provide reasonable notice.

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the service will be resolved in the courts of the Netherlands.

If you are a consumer in the EU, you also have the right to submit a complaint through the EU Online Dispute Resolution platform.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. For significant changes, we will give at least 30 days’ notice before the new terms take effect.

If you continue using the service after updated Terms take effect, you agree to be bound by the new Terms. If you disagree with the changes, you should stop using the service and close your account.
